Coping with Job Loss as a Medic

Of late, I have had a few emails about Job Loss. As everyone knows, I probably know a bit about job loss given the 2007 escapade with Worcestershire Mental Health Trust. Worcestershire Mental Health Trust management has some dysfunctional people in it. I avoided them through the year I worked there. Keeping your head down as a whistleblower is a a talent. This was of course until the GMC started to get their feelers around them. As soon as that happened, Worcestershire Mental Health Trust rolled around like a puppy obeying their every command.

When Worcestershire Mental Health Trust fired me, they had no conscience about it. They simply decided that a GMC investigation on anything was too much for them to tolerate - liability wise and decided to assasinate my job. Following that, they discovered that they were in some serious sh*t.

Of course, as history was to tell us, they lied about firing me and said I had resigned. They then had no explanation for the email sent by Human Resources to terminate my contract. The GMC continued to tickle their bellies and Worcestershire Mental Health Trust continued to waggle its tail and pant like a obedient Crufts dog.

When I was cleared by the GMC and the two doctors at Worcestershire Mental Health Trust were subsequently investigated by the GMC for lying, the Trust had nothing more to say. Indeed, the entire world went silent. It was so silent, you could hear a pin drop. And only doctors or health service employees know the impact of something like this on your future job prospects. You cannot explain it to the public, to journalists or to lawyers. They all perceive doctors to be able to get up and get employed immediately. Of course, in reality it isn't that easy at all.

People ask me about the impact of this specific job loss on me.

To be honest, I had seen dishonesty as a whistleblower but what had hurt most was my consultant's turned back. It was hurtful. I didn't care about the conceited GMC, I didn't care about the insane management there. I cared about Dr John Doran's response. For some reason, I felt that he of all people had known me for who I was. Afterall, I had gone out of my way to help him with his work. Dr Doran though turned a blind eye and effectively went silent. There was so support for me or a word of kindness.

I honestly felt like I was in some Aushwitz concentration camp and everyone had left me there to fry in the furnace. On this occasion, the GMC was the furnace. They had repeatedly wanted to burn me there until I was cindered. I had lost all the friends I had made there - overnight. Not one contacted me to see how I was. My things were packed and they were returned in a plastic polythene bag. Everyone had turned their backs on me.

If people think I took the above in my stride, I didn't. I hibernated to bed for about a month after I was fired. The only thing I woke up for was communication with my lawyer and research against the General Medical Council and yet more job rejections. I believe I may have migrated to bed because I was simply exhausted with everything that had happened.

I was upset about Dr John Doran. It took me a very long time - almost 6 months to accept that even people you pull your tripes out for will desert you in the end. This was one of the lessons in life to learn. Something they never teach you in medical school. The lesson is never to expect anything from anyone in the medical profession. As doctors they may be successes but as people they are utter failures in many ways.

In that year, I looked at Mohammed Asha's supportive team complete with Consultant. Even a alleged bomber was able to obtain support. Yet, in the years I have been a whistleblower, I have never been able to garner the support of a Consultant. I accepted that as long as they did not know I was a whistleblower, they would support me. As soon as they discovered I was a whistleblower, they disowned me. Of course, there is nothing wrong with being a whistleblower in the eyes of the public. In medical eyes, being a medical whistleblower is worse than being a Glasgow bomber. That is actually very true.

Over the years - actually it is now the third year since I lost my job, I developed the idea that one must never rely on people in the medical profession. Their time in medical school and their degrees have never taught them anything. These days, it is easy to pity people who aren't really humans. Those who profess to work in a caring profession but watch the spectacle hoping that the whistleblower will be burnt alive. They exist in a vaccuum of selfish behaviour and and expect us all to overlook it.

Dissociation from the feeling of "loss" is difficult but possible. Time as they say is a great healer in many ways. For a start, you learn to discover the world around you, away from such conceited behaviour. It is the done thing for doctors like Dr John Doran to blame the entire episode on everyone but himself. It is much like they all blame whistleblowers for their predicament as opposed to observing the failings of the medical profession itself.

As life started to be rebuild because quite frankly there is only so much of the ceiling wall you can watch, I gradually left the past behind me. I am not saying the journey was easy, it wasn't but survival is extremely important. The loss of my job in Worcestershire Mental Health Trust was a bereavement. This is a kind of bereavement that I had hoped to avoid. Nevertheless, if you are forced to go through it, you must. Getting over bereavement is hard work. You have to apply your mind to dissociation. Dissociating from many things that in the end are emotional vampires.

What doesn't kill you makes you stronger and I learned something that year - I had spent ten years always giving the medical establishment the benefit of the doubt. On each job, I would try and say that this consultant was a decent human being. I cannot though realistically say that any consultants have been wonderful. There is a certain kind of senior doctor who develop from clones of others. They have no balls, they have no guts, they have no ability to be decent human beings and they start by analysing you as if to say you are the problem - not the system. They just have the ability to sit and judge by their own standards. They manage to judge extremely well because that's their job - to look down on others and measure their successes against others whom they consider to be failures. In that way they can puff their chests out and tell us all how wonderful they all are. In reality, they are just flawed human beings who have no insight into their failings.

They are a certain type of human being and I am a certain type. The two don't mix together - and there is no reason to force the mix. You just accept this difference, adapt and move on forward then never look back.

Blasted Cry Baby

Firstly, I found it interesting that those who were injured in Shrewsbury blast are due to attend their Accident Emergency at the Royal Shrewsbury Hospital. Of course, the doctor who may well be oncall is none other than Mohammend Asha. Asha was involved in a hearing related to conspiracy to cause an explosion but was subsequently cleared.

"Adrian Osborne, trust spokesman, said: “He is currently on rotation in A&E, but as a junior doctor in training he will undertake rotation in different departments to gain the skills and experience needed in the NHS."

Patients can be reassured that they can be treated by a man who hugs terrorists after a criminal hearing. They can also be reassured that Dr Asha a man with such second hand experience of blasts will be able to provide them all with the highest standard of care. We must congratulate the Royal Shrewsbury Hospitals for encouraging the career of a man the secret services have questions over. Of course, this would only happen in England. In India, he would have been deported back to Jordan. A source told the Daily Mail

"But a security source told The Sun that although Dr Asha was cleared by a jury, 'serious doubts remained about his continued presence in this country'.
Why rely on the GMC here?! While the GMC have numerous doctors in their clutches for minor issues, Asha appears to be their golden boy. Bravo GMC.

On observation of the rest of the medical world this week, they are still circling the drains and looking down into the a large cesspit. Professor Michael Baum who cried in front of hundreds of people at a convention has been nominated for the BMJ Lifetime Achievement Awards. Professor Cry Baby is currently convinced that everyone is after him due to his comments made about Palestinian Prisoners. Perhaps when he wins, he will do a Halle Berry and blub even more. May I suggest that a large supply of Kleenex is available.

Then there is Professor Wendy Savage. Not really sure what she has achieved in her lifetime bar being responsible for writing nasty emails sent throughout the General Medical Council. I felt that it was appropriate to post a piece written sometime ago for those who wish to vote for the old bat. Savage though is infamous for creeping up to David Southall and implying that she supports him. David Southall's trail of supporters adore her because they assume she is someone important. Of course, she is really just an old outdated bat. Then again, outdated old bats need to feel important especially with such a bad hair cut.

In truth, when you are in the media, everyone wants a bit of their limelight. Wendy is no different. Anyhow, the original post complete with designer stork can be read here.

Wendy Savage is full of contradictions.

To her, character assassination is often a good thing when she does it. This is possibly because she currently glides at an atmosphere higher than the rest of us common Storks. In the public forum she propagates herself as heroine to the masses. The problem with most heroines to the masses is this, there is always a different side to them. This is what we wanted to examine. The different faces of Wendy Savage is rather interesting.

We looked her up on Google UK to see what was present on old Wendy and lets face it she is getting on a bit and has a reputation to maintain. We wondered if she stood up to our scrutiny. Our interest in her is to assess the quality of people chosen by the GMC to judge the profession. Wendy was of course a GMC Committee member in the days that the GMC was hit by scandal.

Emails have been floating in about Wendy Savage. All were less than complimentary. Wendy was recently referred to in the Times.

One lady told Finlay Scott "Don't you think that the reputation of the GMC has taken enough stick and been damaged sufficiently without asking for trouble by employing doctors such as Wendy Savage as members?" She went onto say "She was suspended from duty on full pay for ages and ages. Is she trying to keep the birth rate down in the East End of London or is she trying to stick up for the rights of women? When Wendy Savage urges women to report their GP for not referring them for an abortion she does not appear to consider that perhaps the GP is also considering that abortion may psychologically damage the woman for life.Yet she is actively encouraging women to publicise the name of their GP who does not refer them by putting his name down on a list in a surgery. Why do you threaten and victimise decent doctors who whistleblow yet reward doctors like Wendy Savage who actively seek to destroy life?" [ comments by an ex nurse]

She gets a glowing write up on the Asha website. The BMJ points out
" In 1985-6, she came under fire for her management of five obstetrics cases. Her determined belief that women should be allowed to chose their method of treatment and delivery opposed the views of conservative theory, that of "doctor knows best." She was charged with incompetence and suspended from clinical work and teaching. Some of her obstetrical colleagues who disagreed with her management fought, often behind the scenes, to remove her from the London Hospital, where she worked. After a 15 month suspension, Savage was reinstated as both doctor and lecturer in 1986".

While she believed that all should be forgiven in her case, she was not so kind to two members who had previous problems with the GMC. We think the problem with old Wendy is that she raises her nose so high that she cannot actually see who she is looking down on. We are of the view that this is the reason she misses the point in most cases.

This is one face of Wendy Savage, the face that she would like everyone to see. Much like the picture of Dorian Grey, there is always another side to people. The cosmetic media image is certainly not the image portrayed within the internal emails at the GMC. On the 24th July 2001, Wendy Savage could not contain herself much longer. Tempted by the internet, she sent a grossly defamatory and malicious email regarding a second committee member. Wendy certainly does not know the art of BCC [Blind copying] and the GMC certainly is not aware of protecting individual data and email addresses. In the interests of supporting the GMC's policy on data protection, we feature what they provided. Thankyou GMC!

Anyhow, Wendy began to aimlessly hit her keys in July 2001. Clearly, Shipman had been convicted by then and she had lots of time on her hands at the GMC Women's Group. Her thumping of the keyboard in a frenzy resulted in a missive that she sent round to all the individuals above. The fact remains that the member she attacked was possibly more dynamic and intelligent than Wendy. We can only assume some mild jealously as the cause of his catfight.

It is clear Wendy had a blip in her demeanor on the 24th July 2001. For anyone interested in the GMC's Whos Who email addresses, just refer to the above. Wendy commenced the gossip session as women do.

She wrote

" I have not sat on any committees with xx and so I do not have any first hand knowledge of how she functions".

She then wrote to Dr Iver

" I should let you know that I am concerned about her mental health. I also enclose the email I sent to the women's group of the GMC before our meeting last month".

An inquiry then stated

" Wendy Savage thought that this seemed over the top and that it was a result of Dr X paranoia, and could not believe that this accusation was true".

Dr Iver then writes back

" To many of us this seems to constitute the denigration of a colleague before other colleagues, including many of her electorate who read Hospital Doctor, and therefore to be contrary to the Guidance in Good Medical Practice. I have known Dr x for years and having been myself in General Practice, my opinion is that she does not have a mental health problem. For you to raise this is unacceptable and questionable. I have no intention of discussing Dr X health or her personal affairs either part or present, with you or anyone else. Furthermore I would endorse her fundamental right to the enjoyment of personal privacy"

Bravo Dr Iver!

We ask ourselves the following question, as a GMC Committee member who rather rapidly made rash assumptions about a colleague's mental health, what sort of member was she? Indeed, is this the way she conducted herself in her day to day activities as a doctor and a GMC member? Did she judge doctor's mental health on a "scowl made towards her"? Actually, if we all had to face Wendy Savage, we would scowl as well. Does that mean we are all mentally ill? This rash decision making on very limited evidence is disturbing to everyone.

Is this the reason why real gynaecologists disowned her? Is this the sort of rapid assessment she did when advising on abortion? Now these are all questions we must ask because clearly the GMC did not feel able to ask it.

So what are the many faces of Wendy Savage? To quote a lady who worked at the GMC once

"Savage is just a nasty old woman, an interferer and someone who tries to fit up her colleagues with psychiatric labels and also tried to gather others into her web of deceit". That is a rather savage critique but probably justified given the evidence we have had to hold back from public view. One would have expected better of Wendy Savage, a lady with a position to maintain. The problem with positions is that it is rather easy to topple off that specific position.

The problem with " paranoia" is that one never knows what else we have up our sleeves to expose next week. Well, Wendy Savage doesn't know anyway. We believe she spent too much time in that women's group gossiping in this manner. Perhaps that is why the GMC never functioned well at all during her time. Too much talking in gaggles of women and not enough work.

Our final question is this, how many babies died due to an inadequate and rapid assessment of the situation? Was an abortion recommended if the woman scowled at Wendy Savage? As a yahoo group message stated "Dr Wendy Savage of Doctors for a Woman's Choice on Abortion said that women should be able to request the procedure at any stage of their pregnancy. The only right about this woman is her name".

Diamorphine Wonderland

Dr Jane Barton - Magical Protection
The Brotherhood of Medicine
- Even Murder Is Allowed

A few months ago, the Gosport campaigners wrote to iwantgreatcare.org a website set up with the assistance of Jane Barton's brother [Mr Christopher Bulstrode]. We waited for a number of months to see whether the entry would be featured on iwantgreatcare.org.

Of course, it's been a number of months and Dr Neil Bacon, Common Purpose graduate has not featured the inquest result etc of Dr Jane Barton.

Dr Jane Barton continues to practice at Forton Medical Centre. According to my sources, no investigation has been done regarding Barton's death rate. A doctor wrote to the PCT requesting this data but it has not been forthcoming. The Gosport Campaigners have written to the GMC for Dr Barton's death rate. The GMC tell them that it is the responsibility of the PCT.

In the meantime, the Expert for the General Medical Council has refused the Gosport families access to his report. Of course, this kind of activity is contrary to the directive on equal disclosure as described in the Henshall case. Thanks Professor Ford.

The General Medical Council promises to be transparent on their website. This is what their website states

"Respect the principles of good regulation: proportionality, accountability, consistency, transparency and targeting"

All this concealing isn't good for the good Professor because the public are bound to look narrowly at him and ask him about his double standards. I actually feel the above decision by Professor Ford should be presented in glorious Technicolor for the world to observe on iwantgreatcare.org. The audience is free to enter it into their database but again I suspect we will find a lack of entry. Christopher Bulstrode is the guard dog extraordinaire and the Lord Protector of Jane Barton. He is the reason why Dr Jane Barton continues to practise in the National Health Service despite a inquest finding against her.

In practice of course, the General Medical Council and their experts clearly believe they are in a playground where the rest of us are fools and only they are the clever ones. Well, this game of hide and seek is looking very silly.

Then again, one would not expect anything different from the lawyers in the swamp - Field Fisher Waterhouse. Reptiles are often rather inefficient out of their natural habitat.

Bagels at Dawn

Firstly, I am just recovering from my Bicardi Breezer overkill. I omitted the tomato juice plus hot chili - burning at both ends combination my friends used to use at medical school. Some things cause necessary pain and gives a new meaning to the usual Italian phrase of "setting your arse on fire". Instead, the piece I am about to write about inspired me to get myself a bagel, smoked salmon and soft cheese.

Late last night, I was reading a very interesting story about the current state of war within the medical profession. The problem with doctors is that they can't help but gossip. Doctors spend more time gossiping like large wind bags than any other profession. The other difficulty with doctors is that they tend to be highly intelligent and with that comes this element of jealousy for others. Doctors don't really need freemasons, scientologists or evangelists to start mobbing their colleagues. Because they are good teamworkers, they can effectively network and destroy people. They also have this sense of arrogance that they are apparently better than the rest of the world. Not all doctors are like this, some can be decent human beings with hearts that work. My medical friends and I have often contemplated the wicked world of medicine. I don't think the public actually understand how wicked the medical world can be. I have found very few decent human beings in medicine. I think that was my disappointment when I qualified in medicine. To me, I had worked hard to be with a bunch of bastards 24/7 and apparently I had to work by their rules. Doctors come in different shapes and sizes. They are bound by the rules of the brotherhood of medicine. The rule is that you never raise your head above the parapet because if you do, its chopped off. There are a lot of chopped heads on the GMC's floor because the first mode of action of those who dislike another doctor is to report them to the GMC. It has been done to me by a group of doctors who posted on Doctors.net.uk. I spotted the similar kind of treatment in the article described below. This is typical of the way boys behave. I have this theory that doctors have always remained sheltered, never gone into the outside world to observe their place in it. It is because of this, they go into some bickering overdrive. They then think that its the most important debate in the entire world. They must be important because they are doctors afterall. In reality, no one gives a damn about these bickerings and fall outs.

Professor Michael Baum is a professor. This means he can say anything and people will believe him. Michael in in trouble. People have been throwing bagels at him and instead of catching them and throwing them back with extra powered unleavened bread, he has decided to tell the conference about his woes.

Professor Michael Baum told a packed session at the annual Limmud conference at Warwick University that colleagues — including Jews — in the medical profession had turned on him after he challenged the accusation made by some that the Israel Medical Association (IMA) was complicit in the torture of Palestinian prisoners.

His session was called “The academic boycott of Israel: are the Jews among the worst antisemites?”

Now, if I said - I am a whistleblower, the medical profession hate my views and had turned on me, the General Medical Council would say I was paranoid. Darn, of course I made that comment in 2000 and they said I was paranoid. But of course, Professor Baum isn't paranoid, he is just a professor and we must all feel sorry for him.

His tale continued

Professor Baum said the personal attacks culminated in a letter sent to everyone on the BMJ website — invoking the name of the Nazi doctor Josef Mengele, who carried out hideous experiments on Jews during the Holocaust — which accused him of covering for Israeli doctors.

It also said he should be ashamed of himself and that the GMC should revoke his licence to practice medicine. “This was written by a Jew,” he said.

“That’s when the campaign to get me struck off started — the worst ignominy any doctor can suffer. They collected signatures and tried to accuse me of complicity with IMA practices. Any attempt to defend myself provoked more anti-Israel and antisemitic rhetoric.”

Anyhow, as the good Professor will know R v GMC Ex Parte Pal ensures that any criticism can amount to "misconduct" and be investigated by the General Medical Council. So, Professor Baum's flame war is now ending up on the GMC's table no doubt. If he wants to rely on Article 10 of the Human Rights Act 1998, he has problems because Article 10 does not apply to doctors [ as per Collins J]. It is said that the GMC can ignore human rights in order to commence an investigation. Anyhow, nice to know my case law is now shown to affect those in the upper echelons of power.

Having pissed the world off, the article stated

"The surgeon went to the Community Security Trust for advice because he was worried about his and his family’s safety. He admitted to his audience that he broke down in tears during a private meeting with Israeli ambassador Ron Prosor"

A grown man breaking down in tears just because some doctors have been mean to him. If we did that, we would be taken straight to the GMC loony bin, locked up, fed bagels by our Jewish GMC Chair Count Rubin and forced to repent. Whistleblowers are sinners you see.

I thought the above debate was about the torture of Palestinian prisoners. Is anyone writing about their tears?! or are they just quietly dying off while we distract ourselves by considering the feelings of Professor Baum. The good Prof should understand quite carefully that real men don't cry, they fight back. If he wasn't ready for the fall out, why write a controversial inflaming piece?

The BMJ and the Lancet have taken this all terribly seriously. The fact that other doctors get mobbed, destroyed, ruined, insulted, defamed, GMC referred in the same way isn't headline news. People are being executed in China but Professor Baum thinks his tears deserve attention.

We were wondering whether the good Professor wanted to go and see a counsellor based at GMC Towers who could talk through the issue in a sympathetic manner. Because clearly the good Prof is looking for tea and sympathy given his current predicament. Any body offering tea and sympathy in Israel or Palestine?

If we read this article - these are a bunch of men who intellectually debate crap. The world is falling apart, people are dying and they are pathetically whinging about their internal bickerings. One is even crying because some organisation decided to actually defend themselves. Some doctors remain in the playground, some become bullies, others become victims. Nothing ever changes because none of them ever grow up.

Mr Prafulla Chandra Pal FRCS. The Real Winner

I finally managed to find the above picture which was taken in 1963 over Christmas and New Year. The good looking Indian guy with Brylcream on his hair was my fabulous dad. My father is known to the General Medical Council as Mr Prafulla Chandra Pal Consultant Surgeon. I like writing about my dad because he was a truly fantastic person. He loved Christmas and always partied over the New Year. Over this period, I often think about my father because there has never been anyone like him.

I am always so grateful that he managed to teach me everything I know much like a legacy. He always told me that I had to make it to the finishing line and not fail. These finishing lines were always interesting because no one was as brave as my father. He was the toughest man on the planet, he brought people back from the dead. That was his reputation as a surgeon. Dad was always into achievement and doing the impossible - because he was everyone's hero. He came from the deepest darkest parts of Bangladesh where he studied by the streetlight, wore one set of clothes that he washed and won the Gold Medal for Surgery at Nilatan Sarcar Medical College then landed in England. My father is still remembered in all the places he worked because he was that kind of doctor. He was the best.

My dad and I didn't need anyone to celebrate the cheque handed to me by the General Medical Council in 2005 through Pal v GMC. I handed the cheque to him because it belonged to him and not me. The cheque was sent to me by post by the conceited General Medical Council legal representatives and I ran straight into his room and handed it to him. He smiled at me and told me " Rita, you have done what no one has managed to do in the history of the General Medical Council". I told him that this was their apology to him for all the distress they had caused him over the years.

After that, we got the orange juice and ice out of the Fridge and celebrated ourselves. Dad laughed after 10 years of illness. He laughed with that amazing laugh that brightened the entire room. We laughed at the General Medical Council. It was a excellent sight - two doctors laughing at our regulator mocking them and savouring that minute where they were forced to fall on their knees. We were both asian doctors afterall and victory to our kind was rare. I had developed my English accent because apparently you need that kind of thing to get on in the world. I preferred my father's Bangladesh accent - it reminded me of my homeland and where I truly belonged. One day, my late father and I will return to the simpler homeland we once left behind. A land that is beautiful, kind and generous. One that does not judge the other by the their style or demeanor but by their heart.

We were a long way from our home in Bangladesh in a strange land where life had become a little too complicated than we would have wanted. Dad spoke of simplicity and the importance of developing the idea of leading a life devoid of a complex world. The cheque he had in his hand had little monetary value to him - it was the journey to it that made the difference. It was the fact that I had made it to the finishing line in one piece and had refused to be abused by a regulatory body that made all the difference to him.

He was proud of me. After that, I didn't need anyone elses congratulations. I remember that very well because out of all the exams, degrees and many other things I have done, the journey on Pal v GMC 2004 was extremely hard, extremely tiring and traumatic but I made it to the end for my dad.

Of course, I would never have made it without my father - he was always the light in front of me, telling me to get out of bed and stop being lazy and start reading case law, telling me to walk for miles in the morning to clear my head, telling me to eat properly, telling me to stop eating chocolate because all my teeth would drop out before his, telling me that I needed to work harder than all the GMC's lawyers to make it to the end because I needed to be the best I could be in this battlefield. My father focussed on making me work at the same speed as four GMC lawyers together. This is very true, I taught myself to type faster than any secretary, to stay awake longer than anyone and never to break.

I must have stayed awake constantly for months, being woken up by my father each time I fell asleep while eating dinner. He would tell me that the sun would come out tomorrow and it would always be a better day - I just had to keep going. During the lead up to the 2004 case, I had not slept for 2 months. There was money to be earned, oncalls to be completed, there was lawyers to be paid and there was case law to be read. I kept going and going until the battle was over then after my father's death, I must have collapsed because I slept for two weeks constantly.

I must have survived through his words and encouragement, coffee and sheer stamina. I look back on the past now affectionately - because winning in 2004 was about teamwork - it was about my father and me. It was something we did together because it was important to both of us. It was historical for me because my father held my hand and led me to the finishing line. I could never have done it without my fabulous dad. My father was the leader of the pack, a true believer in justice and the man who believed anything could be done if you put your mind to it.

And even if I didn't win again, it didn't matter to me - what mattered to me was the fact that dad and I had made it. Behind every battle there is always a story. This is the most important story behind R Pal v GMC. The man who made it happen was my father Mr Prafulla Chandra Pal. I don't think anything will change when we finally meet on the other side again. He will still be telling me to run like the wind and sail through every sea without fear of what is in front of me. Those who dare can win - afterall that is what he always did.

Ms Juliet Oliver Has Left The GMC.

Witch 2 does a runner

Juliet Oliver is now an ex General Medical Council solicitor. She was first mentioned in our write-up sometime ago. Juliet Oliver and have known each other for some years through litigation. Juliet appears not have answered some uncomfortable questions put to her.

Oliver was embroiled in R v General Medical Council Ex Parte Pal. She is infamous for her bizarre paperwork that has never made sense even when you turned it upside down. Juliet likes to manipulate the truth, she also likes to play games and she does this by using language. Language is very interesting especially when you can conceal the truth. Her most famous faux pais was to cite Dr Rita Pal to be accountable under the Human Rights Act 1998. Putting that in writing is even more embarrassing. We had to quietly mention to her that I wasn't an authority in line with the Act and therefore I was not accountable under the HRA.

While R v General Medical Council Ex Parte Pal 2009 was ongoing, Oliver and her colleagues told the world that I had resigned from my job. When she was faced with the email showing her that the Trust ended my contract, she felt a little ill. Having done so, the GMC representative - a eminent leathery Mark Shaw QC decided to seek an adjournment on the basis that they wanted to obtain internal GMC witnesses to back up their lie. Mark Shaw QC's application should be placed online in the future because it shows that the poor man was in a panic having seen the evidence that smited them all to hell and back. Their only saving grace was that Collins J had been too sleepy on a sunny afternoon to spot their lies. We spotted them and in litigation -it's not the win thats totally important but the way the game is played.

Of course, a lie remains a lie no matter how many witnesses the GMC wishes to roll in against me. The fact is the General Medical Council were desperate for any court criticism against me. The problem is, they fell on their face and were not able to establish it. In the end, after crowing through the paperwork on my so called invented resignation, after obtaining their precious witnesses, Mark, Juliet and Lesley had to abandon ship. In the end, they asked the judge not to rule on that point. So Collins J in the judgment didn't rule.

Ms Trick or Treat as we used to call her won the case but sadly for Juliet she is no longer with the General Medical Council. So the casualties during this case were as follows

1. Anna Neill - GMC Register on the case who resigned
2. Finlay Scott - Chief Executive who left the building
3. Juliet Oliver - solicitor on the case who has disappeared from the General Medical Council.

And how do we know this, well through correspondence in the case R v General Medical Council Ex Parte Norman Cave CO/2858/2009. Oliver wrote to Mr Cave on the 11th December 2009 citing that she had left the General Medical Council. We must all thank the excellent Mr Norman Cave for this result. Legions of doctors will be congratulating him in the United Kingdom.

Well, I sincerely hope she finds a more honorable way of earning a living - one that does not compromise her integrity. Somehow through her correspondence, I always felt she was forced into a certain position by her client's demands. We all like to believe that people can forget their dark past and start afresh. I certainly hope Juliet can start a new life away from the GMC. From my side, we had the biggest laugh when she cited that I was accountable under the Human Rights Act 1998. Every single solicitor I showed it to howled with laughter. Perhaps one day Juliet will be able to laugh with us because lets face it - it is hilariously funny for a paid GMC lawyer to make a howling great mistake on paper [ signed] like that.

No one is perfect of course :)

Molly may be Welsh and she may be furry but she is indeed very cute. Molly recently won the Westminister Dog of the Year.

Sadly, Molly didn't have a choice about owners and ended up with Mr Andrew Mitchell MP. Mr Mitchell takes his photo with blue rinse ladies and smiles nicely for the camera shining his super white Hollywood teeth but is actually ineffective. Mr Mitchell is my MP and I would like him to stand down so that we can vote for Molly in the next General Election. Mr Mitchell is also on the Shadow Cabinet. Why DC has him there is anyone's guess.

The media recently crowed away about how much the Conservatives plan to do for Whistleblowers. Of course, this is all a pipedream because I am a fine example of how the effective the Conservatives have been in assisting Whistleblowers. They probably wonder why I am so ratty about Andrew Mitchell MP. Quite frankly I am sick and tired of his pointless letters which go nowhere. He has never understood the issues of whistleblowing and I am not even convinced that he can read properly. He has refused to ask questions about the case in Parliament. He has refused to correct the misinformation propagated about me in Parliament. He has refused to do anything effective. What he does is lip service and this is why I think Molly Mitchell should stand as MP. She would be effective at sniffing out the bad guys, she would be able to follow the lead and she would be able to cosmetically look good. These are all the talents her owner fails to have. In any event, those large floppy ears would be very effective at listening. Her owner appears to have excessive wax affecting his hearing, a blind fold affecting his sight etc.

The other advantage of Molly is that she costs less than her owner. Pedigree Chum isn't expensive and neither are Baker Treats. Moreover, her constituents would be willing to present her with one whole chicken on a weekly basis. By comparison, her owner, Mr Mitchell was under fire for the state of his expenses. While he crows away about World Poverty, he spent £19,000 on cleaning.

Essentially, Andrew Mitchell is minting it while doing sweet FA for the whistleblowers in his constituency. Sometime ago, I stated I would not request any further assistance from him because quite frankly I can do [ and have done] a better job than him without greedily gobbling up tax payers hard earned money.

Everyone knows that I dislike my MP. I have also accepted that he will do nothing effective for my case. That is because he likes his picture being taken, he likes to abuse public money, he likes to milk the tax payer and he likes to write on conqueror paper while crowing away about saving the earth. Mr Double Standards should really resign and make way for Molly who will certainly win everyone's vote.

Merry Christmas

Wishing you all a Happy Christmas and wonderful New Year

This year I am grateful for many things, for my family, for my friends and for much much more. Indeed, having spent many years working in the NHS on Christmas Eve/Day, it is a welcome break to simply spend time doing all the things I have never had time for. I appear to have done too much shopping this Christmas, sent too many cards and eaten too much chocolate. Apart from that, I appear to be much happier in the high levels of snow that I keep digging myself out of.

The above picture is taken from our old anatomy books. On Christmas 1991, four of us sat revising for our anatomy exams. We were so bored of our anatomy books that we ensured our interest was revitalized by some bright ideas. I should admit that I scored the highest in male anatomy. That's not only because I am clever but because I pay a lot of attention to detail. Thankfully, this Christmas there is no revision, books or steths - just pure and simple fun.

I wish you all a wonderful Christmas. I will be updating this blog after the New Year.

Leg-Buckling Orgasms

Faking it.

I have had numerous emails and one phonecall about the case of Bibi Giles. Bibi Giles accused her gynecologist of giving her a number of leg buckling orgasms. The Telegraph approaches the case from a different angle and finally questions the risks to doctors who examine patients in their consulting rooms. Bibi Giles had intended on extracting £50,000 from her doctor on the grounds she obviously didn't enjoy these so called leg buckling orgasms.

"The Guyanese-born Mrs Giles had accused Mr Thomson of bringing her to orgasm by touching her inappropriately, while a nurse stood just feet away. She also claimed he had been putting her under pressure to have an affair and harassing her for six months.

But the lurid claims made by the glamorous beautician – Mrs Giles had alleged that Mr Thomson had given her a “leg-buckling orgasm” during an internal examination at his clinic in Worcestershire – had alerted her former GP to the proceedings.

Dr William Dowley, 45, came forward to tell the court that Mrs Giles had previously made advances to him, after admitting to an unusually high libido. “Life would have been much easier,” concluded Judge Daniel Pearce-Higgins, summing up after the civil claim against the doctor was dropped, “if Mrs Giles had admitted this incident at the start of the case. She has got form.”

If Mr Thompson can indeed do that, I am sure every man would be learning the technique from him. Then teenagers would stop being a bit like a supermarket trolley - pushing and shoving and getting nowhere. Grown men aren't much better apparently. The probability is that Mr Thompson being a man like every other man would have no idea how to cause two leg buckling orgasms. As such, we all knew Bibi Giles was just a serial litigant with an obsession for men and doctors. Dr Helen Bright talked about the Clerembault syndrome but I shall let her write about that aspect of these leg buckling orgasms.

The rest of us who were utterly bored with this story yawned and said two things. Firstly, some of us have warned the General Medical Council about vexatious complaints. The two people who have done so are myself and David Southall [with his entourage PACA]. The General Medical Council piped up as the saviour of all doctors and said the following in the Telegraph :-

"The General Medical Council (GMC), which regulates doctors, says it attempts to investigate complaints as thoroughly as possible before they go to a full hearing, in order that a doctor’s reputation is not dragged through the mud for a complaint that turns out to be “vexatious”. It has just issued a policy that attempts to weed out such allegations at the earliest possible stage"

PACA issued a press release sometime ago before they limped on their campaign. The facts of the GMC's change in mind are as follows, firstly R v General Medical Council Ex Parte Pal which argued the lack of provisions in the event of a vexatious complaint had a permission hearing which was won by me. By December 2008, the GMC had decided to insert a section in the new rules which made allowances for vexatious complaints. Their emails to and from Jean Robinson author of a A Patients Voice at the General Medical Council shows the GMC to have poorly implemented the issue within their rules. They currently have no definition of what constitutes a vexatious complaint and moreover, the directive in the final hearing R v General Medical Council Ex Parte Pal cites that any complaint "capable of being misconduct" is automatically investigated. The issue of vexatious complaints has never been recognised, formulated or analysed by the General Medical Council. Even though the criticism against the civil courts are presented within the above Telegraph article, they do have civil restraint orders to prevent repeated litigation. The GMC has nothing to prevent multiple complaints being taken through their systems. Indeed, their processes outline that the more complaints there are about a doctor means that his fitness to practise is more likely to be impaired. This is of course a flawed concept developed by the GMC. In reality, numerous vexatious complaints still filter through the GMC's investigation processes affecting doctor's livelihoods. In R v General Medical Council Ex Parte Pal, the GMC denied any responsibility for the doctors employment. This follows, any complaint wrongly taken up and one that affects a doctors livelihood has no remedy.

Essentially, the General Medical Council are confused. I argued that I was subject to a series of vexatious complaints following the written material exposing the facts behind the harassment against David Southall but the General Medical Council and the courts ignored the issue completely. They argued that whether it was vexatious or not, it deserved investigation and the loss of my job. The GMC ignored the vexatious complaints from the anti msbp brigade. The fact is that we do not know how many doctors livelihoods have been assassinated wrongly because the GMC has been used as a lever for harassment. The GMC refuses to acknowledge the idea that they are often used as a instrument of harassment.

The case Gopakumar v General Medical Council comes to mind. A vexatious complainant in search of compensation who had a dubious past with the police complained about her GP and got him struck off. The GMC did not bat an eyelid when the innocent Gopakumar was struck off.

Secondly, the issue of chaperones as witnesses was rehearsed repeatedly through the David Southall case. David Southall has been admonished for making statements his chaperone says he never made. Mandy Morris was exposed by Panorama as a serial complainant and someone who manipulated the truth. Essentially, the a complainant with dubious integrity was preferred in place of a social worker who had no previous records of dishonesty. We can then conclude that the GMC itself relies on dubious witnesses as opposed to chaperones. This places doctors in an inordinate amount of danger - i.e. if they cannot rely on a chaperone to verify their actions, what protection is there for doctors wrongly accused?

We therefore have to question this - how safe is the doctor from the General Medical Council? And of course, as we all know the GMC result can be used and abused by lawyers to obtain a court result - and vice versa.

It is a great shame that after all these years, it took a leg buckling orgasm story to bring this issue to the forefront of the media's eye. The fact that doctors have been subjected to vexatious lying complaints for years without a remedy is clearly of no consequence.

Liam Donaldson Resigns. Well Done Remedy UK.

Yes Richard, I had a stashed copy

Remedy UK has long campaigned for the accountability of Sir Liam Donaldson. He was one of the architects in the disastrous MMC. Remedy UK sought a judicial review of the General Medical Council when their complaint was thrown out. They won permission, here is the judgment.

Since their spectacular landmark win and the hand down of the judgment, Liam Donaldson has recently handed in his resignation. The Daily Mail report is here.

Richard Marks is in the Daily Mail providing a superb quote

"Head of policy Dr Richard Marks said: ‘We were after his blood. His review of doctors’ training was done so hamfistedly and it was rushed. We were very annoyed that he messed up but refused to go.

‘He was never independent enough of government. His number one loyalty was always to government than to doctors".

Well, we have to do is take our hats off to Richard Marks and team. It is never too late and 2 years is record time for ousting these government officials. I would have bought Richard a drink had I been in London and congratulated him personally.

I think Richard and I ought to plot more than we did in the General Medical Council judicial review. And of course the good thing about Rich is that he is a delicious devilishly charming guy. In all honesty, I do get a bit distracted but some things can't be helped. Good job he has a wonderful wife who keeps him under lock and key and away from us fizzing whistleblowers. One cannot plot rebellion with short ugly men. Some of us have our standards to maintain :).

Anyway, I won't be missing Liam Donaldson because he is partly responsible for the state of Ward 87 and the complete lack of accountability. These are some laughable CMO quotes. My friend and colleague The Witchdoctor has collected a selection of Liam Donaldson tales, these can be accessed here.
