A Bad Week

Forced to Walk The Line

In the next 10 days both my friends are facing their Interim Order Panels. It is probably time to check out the panelists for any conflict of interests. One is attempting a challenge in court. There is a first time for everything.

This is a damned awful situation for any junior doctor to be in. This is some interesting case law

"that the criteria to be applied by the court are the same as for the original Interim Order, namely protection of members of the public, the public interest and the practitioner's own interests; that the onus of satisfying the court that one or more of the criteria have been met falls on the applicant; that the relevant standard of proof is the civil standard; that the court can take into account such matters as the gravity of the allegations, the nature of the evidence, the seriousness of the risk of harm to patients, the reasons why the case has not been concluded and the prejudice to the practitioner if the order is extended; that the court is not bound to follow the opinion of the GMC or the Interim Orders Panel, but can take it into account and give such weight to it as the court thinks fit". General Medical Council v Sathananthan [2008] EWHC 872

In the meantime, I have found out that Elizabeth Paice of Plaice Towers was involved in shafting a medical student some years ago. My jaw dropped following the document I was sent. More on this later in life. Nevertheless, that rogue dean should be taken away from her job and retired on whatever grounds the GMC can think of. No Interim Panel Order for Paice then. Shame really.
