Men In Kilts - What Lies Beneath.

Is there a consultant in the
profession with a good set of balls
then?

Today, I spent part of the afternoon researching suspensions. It is Sunday and I have been having word finding difficulties. This is what normally happens when my brain slows down a bit after Sunday Lunch. Jobbing Doctor has always come to the rescue. That is because he is my hero :) [ looking up at him with doe eyes as we speak].

I have written on my favourite topic of the moment - the Scottish SpR. I outlined the illegality of the suspension. Jobbing Doctor though points out quite rightly

"You outline a very good case for what is, I believe, called Natural Justice. I believe that Professors Paice and Needham have acted outside their jurisdiction, and therefore are at risk of being countersued for prevention of a doctor carrying out his lawful occupation, and also unfair character assassination. This suspension needs to be revoked forthwith"

The key words here are Natural Justice which I missed out. The second point is that Paice and Needham have indeed acted outside their jurisdiction.

My prized discovery this afternoon was this website http://www.suspension-nhs.org/ . I have never been suspended myself so I have no idea what it must feel like. I suspect it must feel terrible.

Of course, my argument here is this - I don't have to be the one complaining to the General Medical Council. Where are the big guns and the leaders of our profession? Where is Graeme Catto in all this? He knows about medical education, has contacts with Scotland and probably wears a kilt, so where are they all ? Why is there this uncomfortable silence in the top level medics? What lies beneath the crowing words about protecting junior doctors?

Perhaps someone will let me know who is protecting the rights of this Scottish SpR. Just for avoidance of doubt, I have raised this with the Department of Health today. While all this is being done, let me know if any consultants are currently rallying around to protect Dr Sean Connery SpR. If he has his selection of Men in Kilts then he will not need us.

This is the last post I shall write on this subject on this particular matter until there are updates this week. I am particularly in need of a holiday and some TLC. In the absence of any Scottish heroes, I am disappearing back into my whistleblower hermit hut for 24-48 hours. I shall though be back.

The Kilt Tales by Witchdoctor

Witchdoctor Tells Us What's Under the Kilt.

"The Oldest Sage Witch wants A Long Flowing Kilt. Not the usual kind of kilt. It has to be made of the purest silk and pleated at the back. It has to be a very long kilt that comes right down to the ankles as befits a witch of her age. She wants A Silken Plaid pinned to her shoulder to flow in the night air as she flies on her broomstick during the witching hour"

I should of course explain to the world that in 1991, I was a very naive shy young girl , fresh from the sticks who went to a big city in London to be a doctor. I had never seen a proper man before never mind men in kilts. I went to the Freshers Ball at a swish hotel dressed in a black ball dress. There were two men dressed in kilts who looked absolutely breath taking. Both were drunk but life cannot always be perfect. The scene of these two men is something I do remember very well. In fact, I spent an inordinate time that evening being fascinated by their legs. Of course, I never asked them what lay beneath their kilts. Perhaps someone could outline what lies underneath a man's kilt for me one day :)? I couldn't possibly speculate -being a nice innocent little indian girl :).

In fact, I penned this on the Telegraph a few months ago regarding my fascination of Scottish men.

So, yes, I have a soft spot for all Scottish men. Alas, I am a taken lady, imprisoned by my crossbreed [ 1/3 Scottish, 1/3 Irish, 1/3 french] man who refuses to wear a kilt . This does not mean I am immune to views on the horizon. Indeed, my visual acuity for men in kilts is rather excellent.
Of course, I have high expectations of our Scottish SpR. I expect him and his friends to line up decked in Kilts. I expect him to take a photo of all of them and send it by email to me. That should be done after his suspension is lifted of course. As surgeons, they should appreciate that for the last 10 years I have worked with psychiatrists and general physicians who can never be deemed as "real men" :). I have therefore been denied the wonders of Scottish men. I therefore hope these surgeons in Scotland will take pity me and send me a kilt clad picture. Besides, I am positive they would understand the requirement for anatomy revision. Frequency of revalidation is required in all women.

Tomorrow, I shall pen - Men in Kilts. As we all know, only real men wear kilts :).

Of course, there is Trouble Ahead :).

Defence Unions.
Helping Deans Cope With the Unexpected.

I have no idea why my minor complaint to the General Medical Council has caused such controversy. There is nothing brave about it. It is simply a necessity. Everyone else may wish to sit around and moan but I don't feel like it. In fact, I feel like challenging the status quo. Witchdoctor calls it serious double trouble. I call it mild jousting with some despots.

Lets face it, either we have 1 SpR as a sitting duck at Gillian Needham's special prison for junior doctors OR we do something about it. For avoidance of doubt, the Scottish SpR had nothing to do with the GMC complaint and neither did his friends. It was all my idea. Yes, even I can think with one neurone occasionally :).

Gillian Needham and Elizabeth Paice may wish to compare notes with the other big shots in the land eg Professor Rod Griffiths who has been subject to GMC procedures for almost four years now. That is because I don't let go and most people know it. In the case of Griffiths I did indeed thrash the Department of Health lawyers to win a Rule 12 application. A Rule 12 application is when the President of the GMC reviews the decision of the case examiners. Whether I win or lose against Needham and Paice is not dependant on justice but more dependant on the close connections they have with the General Medical Council. They may well be on the phone to Gossipy Despot 3 Carol Black moaning away about how rude and unprofessional I am. Of course, I am rude. That doesn't mean I don't have a bona fide complaint :).

In any case, I am all for data retention when it comes to Deans. Complaints recieved by the GMC are stored forever in their files. They invented the process, the Deans can live by it. It is only fair and just in this world of injustice that there is a formal record of bullying and harassment against the two Deans. The GMC complaint is a formal record whether it is thrown out or not. Of course, if it is thrown out at the first stage, we will understand that our friends Carol Black and the two despots have been in touch with Finlay Scott and Catto exerting undue influence. If it goes past the first stage, we will see that the GMC may be trying to be fair. The GMC may wish to avoid a revolt. They know the peasants are already revolting.

It appears clear that they lifted the suspension for 3 days just to appease the Sunday Times then when the media had disappeared, they placed it back. Isn't that the height of wickedness? Of course, it is. Forget the fact that the suspension is now probably illegal. Is anyone paying any attention to that? Lets see what our source say again

"He is still suspended, despite local advice to reinstate, regionally needham has blocked his return. The local disciplinary committee and LNC recommended no action to be taken against him, but the deanery has continued the suspension".

So which part of this suspension is legal Gillian? I would quite like to know. I would quite like to know HOW the Highland Deanery can justify such a suspension. Gillian feels she doesn't owe anyone an explanation. Of course, she does owe all of us some explanation.

By the way, if any kind soul can forward me the anti bullying and harassment policy for the Highland Deanery as well as the formal complaints procedure for said deanery, that would be excellent and I would be grateful for it.

It must be a great shame that some people cannot be controlled by fear. Why am I interested in our Scottish SpR? Because it goes to the heart of fundamental human rights that are denied to doctors everyday.

By the way, anyone is free to anonymously write to the GMC now in support of said complaint against our two Deans :). Use a Gmail account and email jsmith@gmc-uk.org. It is irrelevant whether the complaint is made by me, the GMC have the powers under the Medical Act 1983 to take up said complaint on their own in the public interest. "Public interest" is probably defined by the number of supporters the complaint gets.

Get this party started

Get the Party Started. Love this track

I came back home today to a range of worried and concerned bloggers. Witchdoctor outlines the tale.

This is my solution while everyone is moaning and giving up.

1. The doctor sets up a gmail account. IP address is not normally trackable.
2. We create the blog on blogger and post for you. Essentially, you send us what you want.
3. This is what we do on nhsexposedblog.blogspot.com for all the writers.

The only IP address that is trackable by Google UK is ours. Most of our servers for NHS Exposed remain abroad so we have space to move more controversial material away from jurisdiction. Anyway, the offer of anonymity always stands but as I told Witchdoctor, most trust us or me less than the stasi so we shall leave it there. One can lead the posse to water but cannot force them to drink it.

As for Dr Grumble - if you are going to fraternise with the masses, someone is going to find you :). The price of fame. Being a top medical blogger isn't easy. I am of course a lowly little medical blogger :):).

Prof Gillian Needham Seeks Petty Revenge

Gillian Needham Ties Up Her Male Doctors.
Dr Sean Connery has been kept out of work
so long that his beard has grown grey.

Following a number of anonymous emails, it seems that our Scottish SpR Dr Sean Connery is still suspended. One email stated :-

"He is still suspended, despite local advice to reinstate, regionally needham has blocked his return. The local disciplinary committee and LNC recommended no action to be taken against him, but the deanery has continued the suspension"

The other email was sent by a rather dashing young thing. There is always something about a man in disguise. As I say, I am simply destined to speak with shadows. That is fine, as long as the information floats in. I have absolutely no problems with dashing young male doctors as everyone knows.

My problem lies with old Gillian. Jobbing Doctor has the right idea of course.

"Toughen up, ladies. If you want to lord it over the profession from your marble halls, then be prepared to accept criticism. You should be spending your time getting the mistakes of MMC and MTAS corrected, rather than indulging in a vendetta against a lowly trainee"

Someone this week suggested I was sexist. I agree, I probably am. This is what I said about the different types of women

1. Those who think they are better than men. They are the sharp suited kind
2. Those who are better than men but don't have to show off
3. Those who take the place of men and think they can do the job properly.
4. Those of us who are totally cool :)
5. Those who are downtrodden types

Paice and Needham come in at a number 3. Of course, no man can say this because men would be accused of sexism but I can. In fact, I can say a lot of things that are rather blunt.

For Needham, she likes the control. Controlling a man despite the fact he is a trainee is probably giving her a sense of power. For a lady [??] who has lost all her power - internet wide, I suspect this is the last leg of her revenge.

And women do know about petty revenge don't they?
Gillian wants to punish Dr Connery until he can take no more. For get legality :). What Gillian wants Gillian gets. It is called " abuse of power". Thats what Deans do especially those unable to do their job properly.

Perhaps Gillian requires some anger management.

Rather difficult to sing if she has a green complexion.

Gillian's rather OTT reaction to the out of hours activities of a junior doctor is rather surprising. Perhaps we can understand Elizabeth Paice a little because she is just a despot. Gillian though is becoming odder and more bizarre as time floats on. Perhaps she likes being seen as an oppressive despot, who knows.

Anyway, as I have won about 2 Rule 12 applications at the GMC ,I currently have about 4 doctors in there, 1 who had a warning, I have Professor Rod Griffiths on a Rule 12 again, I have the GMC coming up to a judicial review with me, I saw no harm in penning a short missive to the GMC while eating chocolate cake this Friday. In my view, the GMC can make themselves useful.

In the old days, I was fairly good at physics so perhaps for every action there is always an equal and opposite reaction. I didn't think there was any point in pussy footing around and talking about referrals to the GMC. As no other doctor can do this safely, I did. As Dr Sean Connery is due to have a complaint against his name forever at the Deanery, there is no harm done if the two Deans had complaints registered forever against their names. It is all about data retention afterall. The sort of things both deans campaigned for. It is only fair that they are subjected to the identical treatment in the interests of equality.

Paice and Needham know about this. I hope they all have a lovely weekend. I know, I shall! :)

Saving his Bacon

Some men are simply meant to be boars
who wallow in the same cesspit as NHS/GMC Management.

I spotted an interesting piece recently. It was all about medical blogging. The piece is worth a read. Rather interesting actually.

"Blogging is increasingly offering a colourful commentary of life in the NHS and writers argue decision makers would do well to pay attention. Jo Stephenson asks if managers should be afraid"

Jo Stephenson of course missed out the real campaigners against iwantgreatcare.org - Jobbing Doctor and Witchdoctor who have both done a sterling job in keeping the issue alive [loud clap].

I had to howl with laughter at Neil Bacon

"I never read them," declares Neil Bacon. "They are just the unedited and ill-informed views of individuals who like the sound of their own voices."

Dr Bacon has himself been a target of bloggers' ire, after setting up the website I Want Great Care, which allows patients to rate and review doctors like a book on Amazon. The patient critiques are anonymous but Dr Bacon maintains there is a difference in that the site aims to gather the views of lots of people rather than provide a platform for a lone critic or admirer.

He believes managers can get a lot out of online communication - including blogs - but only if it is two-way. Editing negative comments or leaving them out defeats the purpose, he says"

Ah but those are voices that are read, understood and analysed :). I also love these listings. We won't mention the visits from iwantgreatcare.org on our websites then Neil :). Neil though ought to learn about what a blog is. Just for him, here is a definition

"A blog is a personal diary. A daily pulpit. A collaborative space. A political soapbox. A breaking-news outlet. A collection of links. Your own private thoughts. Memos to the world"

As he has a personality of a large boar, I have no doubts that all women would fall asleep if Neil started to write a blog. He has as much charisma as a floating amoeba. In addition, his money management skills need some fine tuning. A 2 year old could do better.

I suppose Bacon does not like the sound of his own voice when he has crowed in all the newspapers and the current journal. I shall leave both Witchdoctor and JD to analyse whether they feel Mr Bacon's views are unedited and ill informed. Mr Bacon clearly lives in his own ivory tower. He also lacks insight. He also tells little white fibs hoping the world won't notice.

Jobbing Doctor has been seeing the similarities between Neil and the live slugs he finds in his garden. We therefore assume JD dislikes this man.

Of course, Neil fails to comprehend the influence of bloggers. Clear Blogging outlines it. Harnessing collective power can also change the world. It is therefore clear that our so called internet enterpreneur is now behind the times. Perhaps Neil now requires his pipe and slipper s. He may wish to settle down to being a has-been. He also needs to realise that his website is a catastrophic failure. Is there any treatment for delusions of grandeur?

This amused me from Worcestershire Acute Hospitals.

John Rostill, chief executive of Worcestershire Acute Hospitals trust, says he started blogging to try to engage more with staff.

"I didn't do it to enter a competition and wouldn't set out to make it funny," he says. "The blog isn't for my benefit - it's not to vent my frustration but to educate and inform others and let them know what we're doing."

Would he be worried if he found out a member of trust staff was blogging about work? "It wouldn't worry me at all as long as there was no breach of confidentiality," he says. What if he featured in a blog? Mr Rostill pauses. "I say I wouldn't mind but it depends what they wrote. It wouldn't be the first time that people have written about me and I might not approve, but then we didn't come into this job to be popular.

"If it generated a bit of healthy discussion, I'd encourage it."

Of course, it is a well known fact that Worcestershire NHS Trust fired me as soon as they found out I had been blogging. Here is what Worcestershire NHS Trust had to say.

"Worcestershire NHS confirmed that Dr Pal left after it became aware of the GMC's investigation, but refused to comment further, citing confidentiality"

Having told the Register that I had " left", it was interesting that they failed to tell the world that they had actually fired me. There are two pieces of evidence showing this, an email from the Human Resources Department and the confirmation from the locum agency citing " You were fired". The final piece of evidence was the confirmation from the agency to the GMC that I had been fired as soon as they were informed that I had been blogging and this was a matter of GMC investigation. The complaint was thrown out on its proverbial legs. WD and JD will be amused to learn that the decision in the GMC complaint could not differentiate between the blog and the website :) and got the URLs confused. What was it I said about amoebas and the GMC?

Worcestershire NHS Trust has still never apologised despite the fact they fired me unnecessarily. It was rather expected of those who really lack imagination, those who run a service that doesn't work. I did of course whistleblow on them once and I shall do so again. It is just a matter of time isn't it Dr Monterio. They can be found on their daily guilt slinking visits to the nhsexposedblog.blogspot.com.

The forthcoming judicial review will be interesting because Worcestershire NHS Trust will be starring as the premier Trust, one of the first to fire a blogger for her controversial views. Mr Rosthill is not quite as fair as he would like to appear.

I love this warning from management :).

"Blogs are a good way of communicating informally but anyone entering the blogosphere should know where they stand when it comes to the law, says NHS Employers joint acting director Sian Thomas. "Although relatively new, blogs are covered by existing legislation and anyone blogging needs to be sure anything published conforms to UK legislation and their own contract of employment," she says.

Employers should have well-publicised policies covering the use of email and websites at work. Trusts should also have whistleblowing policies for employees. "Publishing inappropriate material in a blog is usually unacceptable," says Ms Thomas. Most NHS staff have confidentiality clauses in their contract which, if breached, may lead to disciplinary procedures.

"Anything published on the internet is also subject to libel laws," she adds"

Yes, that nice veiled threat to all doctors in the UK.! Well, there are ways of blogging completely anonymously and we know how :) :)>. In any case, if doctors can't blog, we can do it for them :). For avoidance of doubt, every NHS Trust, every NHS manager and every defence union failed to sue for libel on msbp.com. They also failed to bring the website down. Moreover they could do nothing due to the anonymity of the posters there. Now, if we apply the same principle to medical bloggers - no one is going to find them [ not if we help them anyway]. Let that be a message to the NHS Trusts/Management and the stasi at the General Medical Council. Free speech is here to rule. While there is tyranny within the NHS, there will be free speech through the blogspace. In my view, the NHS, the defence unions and the regulatory bodies have had too much control for too many years. It is now time for some accountability.

North Staffordshire NHS Trust is free to sue me at any time and any day and in any court. I am very happy to meet their hopeless lawyers affectionately termed Mills and Boon [ Mills and Reeve] :) :). Oh, I am quaking in my boots :) [ thigh length leather ones of course]! Normally, the lawyers turn up with law books and I turn up with the evidence :)>

Discreet Confidential Enquiries

Dr Grumble points us to Section 44 of the Terrorism Act. More information is listed here. I don't much like the police powers these days. I doubt that many people do.

On a lower scale, I have course been investigated by the General Medical Council "discretely". This was an admission made by the GMC themselves during a memo written internally. I raise this memo written by Dr Sheila Mann because it shows that an organisation such as the GMC can conduct inquiries behind a doctor's back. It is fine for us to go around the world admitting that these things don't happen or that they only happened to me because I stepped out of line one sunny day. The fact remains that the GMC have been conducting these " discreet enquiries" for years. It should be noted that I had no idea that these discreet covert enquiries were being carried out. I found out completely by accident. I also have no idea what the General Medical Council actually did during these covert enquiries. It is an established fact that this discreet inquiry was done "out of procedure". This means that the GMC didn't even have a formal complaint to act on. The high water mark admitted by the GMC was a typographical error I had made on a letter to them. This according to the GMC gave them the right to violate my human rights and covertly investigate me. Of course, the above was before 2004, before the new laws RE RIPA and before the current police state. The matter will no doubt become far worse now.

The above becomes a rather boring subject but it is important in the grand scale of the manner in which medicine is conducted these days. It is indeed all about control. Essentially, all authorities have the power to do whatever they like on minimalist evidence. That is a worrying thought. In the GMC's case they cite the " protection of the public". In the police's case they cite the same sentence.

I watched In the Name of the Father the other day. The case of the Guildford 4 should tell us how corrupt the system is. 4 people were sent to prison, evidence was concealed, one man died in prison and there was no accountability.

They were tried and convicted on 4 March 1976 and received the following sentences:

  • Anne Maguire, aged 40, was sentenced to 14 years
  • her husband Patrick Maguire, aged 42, was sentenced to 14 years
  • their son Patrick Maguire, aged 14, was sentenced to 4 years
  • their son Vincent, aged 17, was sentenced to 5 years
  • William Smyth, brother to Anne Maguire, aged 37, received 12 years
  • Patrick O'Neill, a family friend, aged 35, received 12 years
  • Patrick "Giuseppe" Conlon, brother-in-law to Anne Maguire, aged 52, received 12 years. Conlon had travelled from Belfast to help his son Gerry Conlon in the Guildford Four trial.
After 15 years, they were released. The Prime Minister apologised.

That should be a lesson that our system cannot be trusted to conduct itself in a fair and judicial manner. That is due to the complete failure of accountability starting with the police downwards. There is currently nothing preventing the General Medical Council abusing the powers of the state. They have done so in the past and they continue to do do. There should be no illusions about the GMC, an organisation who frequently makes use of detective agencies to do their work. That is the essence of their covert enquiries.

This is an interesting finding in the Guardian newspapers

"Peter Jay is Managing Director of MedicoLegal Investigations Ltd (MLI), a small company which investigates questionable research carried out by doctor. He was previously a Metropolitan Police Detective Chief Inspector and was also a salaried investigator for the General Medical Council (GMC) solicitors for six years"

How to sue Elizabeth Paice and the London Deanery :)

Doctorportal had an interesting article. I am listing this here in the hope that some clever little junior will pass it around.

Deaneries ruling is good news for juniors

2008 Aug 22, Francesca Robinson

Junior doctors may be able to take action against their deaneries if they do not receive adequate information about their posts, following a ruling that deaneries are employment agencies.

The clarification about the status of deaneries has been obtained by the BMA’s legal department from the Employment Agency Standards Inspectorate (EASI), the body entrusted with regulation of employment agencies.

EASI has stated that the postgraduate medical deaneries appear to be employment agencies and as such would be required to comply with the requirements of the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

The BMA has reported all the deaneries in England to EASI for not meeting these requirements in the past.

The association will now be pressing to ensure that EASI carries out its statutory function to ensure deaneries provide accurate information to junior doctors when they offer them a post, such as when and where they will start, what hours they will be working and how much they will be paid.

Mr Ram Moorthy, Chairman of the BMA’s Junior Doctors Committee, said: ‘Unlike most professions, junior doctors can start a job without knowing how much they will be paid. It is about time deaneries are required to comply with the same regulations that apply to other employment agencies.

‘We hope that EASI will now take the necessary steps to regulate deaneries in the same way it currently treats other employment agencies.

‘It is a scandal that deaneries have been able to give junior doctors so little information about their jobs. The BMA intends to pursue this matter as it is clear that EASI has an obligation to use its regulatory muscle to ensure deaneries provide accurate information to juniors so that they can make informed decisions about each step on their career ladder.’

Mr Moorthy said that the EASI clarification meant that some junior doctors may now be in a position to take legal action against their deanery if they lost out or suffered because they did not have access to the necessary information throughout a training rotation.

RUFF RIDE

Bulstrode is having a ruff ride at the Nuffield

Jobbing Doctor has been assessing the Glasgow Coma Scale. JD is a clever doctor. Witchdoctor has been postulating over the designer nightwear sported by Bulstrode. Both have not noticed that Neil Bacon has Bulstrode on a leash. Both have also failed to notice the additional post midnight facial hair. Neil was spotted hotfooting it down to the local Pets and Home to purchase a selection of Markies. Markies apparently are presented on a platinum plate to Bulstrode in payment to pose in different nightwear on iwantgreatcare.org.

The above is the new designer NHS nightwear worn by Bulstrode while oncall at the Nuffield. This attire apparently happens after midnight and during the full moon. Bulstrode had no explanation for the additional facial hair blaming it all on his fictional high testosterone levels. He was said to be dog tired due to the number of recent increased trips and falls in Oxfordshire. That was just the solicitors at his door. Bulstrode was later seen following Neil Bacon around hoping for another Markie. The rest of the medical profession has been walking behind Bulstrode with a crucifix and holy water. Afterall, Bulstrode did predict

"Doctors will feel threatened, and rightly,
as one or two will find their trousers round their ankles"

Miles Away

Madonna - Miles Away. Hard Candy

A friend of mind pointed out that for a music geek, I had very little in the way of my favourite music on here. I am therefore seeking to rectify this. I have always quite liked Madge. Her music for me signifies and defines certain years in the past. In fact, that is exactly how I remember the chronology of Ward 87 or anything required for the courts. Bit sad really but there you go. The other issue about Madge is the fact she reinvents herself as decades come and go which is a good message to anyone. I love the above track as it reminds me of someone who matters a lot but always remains miles away. There has always been someone who has walked past me. He continues to walk past me and will always walk past me.

The Shark's Advice "Hopefully that will have the desired effect and make her go away"

Legal Advice to the London Deanery/Prof Brenton

To continue the tale of hag towers, we need to review the letter that was sent from John Hull of Denton Wilde and Sapte to Prof Brenton [University College London].

Brenton was no doubt acting on behalf of Prof Paice and her fellow hags. I have no doubts that a lot more went on between Paice, Moss,Brenton and the powers that be. Their job was to silence me and ensure a tight grip. That is why their focus was on me and not the accountability of Ward 87.

All three sought to " cover up" the disastrous issues on Ward 87. At least Brenton did not want me knowing his views on the substandard care. They also sought to support their fellow patient killers over at Ward 87. What else can we call them but patient killers? Isn't that what the doctors responsible for Ward 87 were? I suppose we could be politically correct about it and use more tame words but what would be the point? We could skirt around and be polite about death. Isn't that what the rest of the top level professionals do?

The advice above shows the London Deanery engaging in purposeful concealment and obstructing any path of accountability. My request to Brenton was very simple. The old fool could not even accede to this simple request for personal data. Of course, in the end Brenton taught me clinical medicine but over the years, I found him to be a failure as a person. David P Brenton is now quietly retired, takes no responsibility for this fiasco and cares nothing for what happened. To Brenton, it is the decorum that matters - not the fact that patients died. I discovered that in the end. I also discovered that he didn't fully believe me. He didn't even fully believe the 2001 report. In fact, he believed polite lady like behaviour was more important than patient safety. This is the reason why he sought to obstruct my path, he sought to make my journey more and more difficult hoping I would essentially give up. As for careers advice, none of them offered any.

I suspect the same can be said for Donald Irvine. In their well brought up English accents, they look down on the rest of us and " poo poo" the "behaviour" but say nothing of the patient lives that were paid because none of them bothered to lift a finger to assist. I wonder if their mind's change the older they get and the more closer they are to their graves. I wonder if this lethargy to death improves. The problem with older doctors is that they have accepted negligence as the norm in the NHS. This is also why they feel everyone else should overlook it because it has been done for decades. This is why they also engage in covering up controversial issues. Injustice becomes accepted behaviour. This is why the seniors need to bring us juniors into line to "accept injustice". Those of us who don't accept the dark side as they have done are termed "difficult personalities".

Accountability is not in their blood, it never has been in their blood. That is the reason David Brenton and his hags decided to take legal advice on what was a very simple request. This was because David Brenton didn't want to be embroiled. Didn't want to support one of his students. He wanted to wash his hands of the matter and remain a coward much like the rest of his colleagues.

This was a request covered by the Data Protection Act 1998. The letter was written in the year 2000 and the lawyers were aware that I was entitled to my personal file. They sought to mislead me. The advice above is contrary to the Data Protection Act 1998 showing that reputable law firms engage in the path of the dark side.

It is one of my favourite letters because it shows us all what conceited cold hearted people, lawyers can be. They can even advise that the Deanery deny basic documentation to a victim with the sole purpose of obstructing justice. In my previous posting, I did wait for Brenton to retire and approached the Information Controller directly. The documents that Brenton had concealed from me were released a few years later. I suspect it was a fairly underhanded under the radar approach but it worked.

My favourite sentence is this

"In the circumstances therefore and particularly given Dr Pal's apparent desire to publicise information emanating from others on her website, my advice is that Professor Brenton write to Dr Pal declining to provide a statement and declining, on the basis of other overriding duties I have mentioned, to provide documents to her. Hopefully that will have the desired effect and make her go away"

So I made a complaint to the eminent law firm while citing that the firm had denied me essential documentation I was entitled to. This unethical behaviour of a law firm which boasts as follows

"Denton Wilde Sapte is an international law firm with over 600 lawyers and a network of offices and associated offices spanning the UK, Europe, Middle East, CIS and Africa"

This was their response.

Subject: Complaint relating to John Hull

Dear Dr. Pal,
I have now conducted a detailed investigation of the complaint you made on 14 May 2005.
1. The first issue I considered was whether your complaint was a legitimate basis for complaint under the firm's complaints procedure. I have concluded that, if a breach of the Data Protection Act 1998 has taken place as a result of advice given by this firm, as you allege, the appropriate remedy is a claim under that legislation. Our complaints procedure is not designed as a substitute for or supplement to third party statutory or other legal rights against our clients. Accordingly I have concluded that the basis of your complaint is not valid.
2. Nonetheless, one of the objectives of our complaints procedure is to enable quality control checks to be carried out where concerns have been expressed. Accordingly, as your complaint alleges that incorrect advice has been provided by this firm (albeit not to you), I concluded that the allegation that the advice was incorrect should be investigated as part of our internal quality control process.
3. I have therefore examined the advice given and the context in which the advice was given. I have concluded that the advice given was neither incorrect nor inappropriate and that the complaint is not justified. I cannot give you any further details on the background to my conclusion as, to do so, would breach client confidentiality.
Kind regards,
Helen Cleaveland

For avoidance of doubt, the material presented on this website is simply a product of my investigations over the years. The investigations have not been obsessional but it often entertains me intellectually to watch the way law firms behave. I also find it highly entertaining to establish that there is actually no accountability in the NHS.

Finally, I did get one up on John Hull - he may have been clever - but just not clever enough to be a step ahead of me. So essentially, even with his sharp suit, his fat pay cheques, his conceited behaviour and his posturing, he still wasn't able to prevent me from uncovering the document I needed. Amazing what can be uncovered when no one is looking :).

Amazing silence isn't there? All these defence unions visiting the website :) and none of them have a thing to say.

Cat got your tongue Prof Paice? Has anyone got anything to say now? Of course, not.

Professor Elizabeth Paice - The Gutless Wonder

It is August 2008. In 1994, many years ago, I apparently won a prize at medical school. It is only today that the letter and prize money has turned up. Throughout my entire shortlived career as a doctor, I have been told by Paice's cronies that I was somehow less competent than my peers. Perhaps that is what the prize for " Best Student" of the firm means. To observe Paice's cronies in action, one has to review a early letter to the London Deanery written by Professor David Brenton of UCL.

My dealings with the Paice department of hags was previously discussed here. The above letter is from Professor David Brenton. It was sent to Fiona Moss. Fiona Moss is another one of those batty women who works next to Paice.

Here is Fiona Moss

"Fiona Moss has been a Consultant Respiratory Physician at the Central Middlesex Hospital, London. Since 2003 she has been one of London's Postgraduate Deans. Her responsibilities include Postgraduate Medical Education in North West London. Her current work includes; helping trusts set up the framework for Foundation Programmes, supporting the organisational development and changes in working patterns needed to enable trusts to meet European Working Time Directive targets and maintaining quality of service and training. From 1992 until 2004 she was the founder editor of the Quality and Safety in Health Care, a BMJ Publishing group journal. She is Senior Associate of the Judge Institute of Management, Cambridge and also of the Nuffield Trust. She is on the Editorial Board for the BMJ/NPSA and is on the Medical Advisory Panel of the NPSA"

Paice sits quietly in her office while more documents regarding her misdemeanors return to haunt her. Everyone is no doubt aware of her crowings on protecting junior doctors from being bullied. It is all a lie because Paice cares about no one but herself. The above letter is interesting as it admits to patient neglect on Ward 87, it admits that the Deanery focused on me rather than obtaining accountability for Ward 87. Dr Moss was editor of "Quality and Safety in Health" :)

Paice's action should have been to remove me immediately from West Midlands Deanery and ensure I was safe in London as I was her responsibility. Fish face Plaice and her collection of hags deny all responsibility despite the GMC guidance and the Medical Act 1983. This goes to show that Paice is of the view that she is above the law. She sits quietly in the hope that everyone will assume that she didn't know about Ward 87 and that I am making a mountain out of a molehill. There are no molehills here, there are just bare facts and evidence. Come on Professor Paice, why don't you respond to this whistleblower for a change, why don't you apologise for the mess you made of 1998? Why don't you stand by all those articles on bullying and victimisation and patient safety.

Here is what the two faced plaice says on her website

"The London Deanery is working to improve the quality of patient care by ensuring the supply of doctors and dentists who are educated, trained and motivated to play their part in a first class modern health service"

Ok, Professor Paice, lets see you improve patient care. Lets see if you have the guts to put your words into action. Why don't you discuss this case with Carol Black and hold those responsible for Ward 87 accountable? I see you are quite capable of ringing up the Highland Deanery to get doctors suspended so why can't you get the doctors responsible for ward 87 suspended? Why don't you do you job for a change?

By the way, I don't give a flying fuck what Paice thinks of my attitude or my manner of writing on the internet, one thing is for sure is that I have the goods and the evidence that makes a mockery of those in the highest positions in medicine.

The London Deanery have no answer to the above. They have no answer because they are a catastrophic failure - always have been and always will be.

Prof Brenton was sent the 2001 Report by post. He had nothing left to say after spending large amounts of time postulating on my so called competence levels. Why can't we talk about Dr John Green's or Dr Monica Spitieri's competence levels? Why can't we talk about how the Trust protected them? I suppose that would be rather controversial wouldn't it? Actually ensuring patient safety is another matter for Prof Paice. Perhaps that comes lower in the pecking order.

NB The above document was obtained under the Data Protection Act from the London Deanery. Previously, this had been denied to me by Prof Brenton thereby compromising any litigation I could have brought. The London Deanery's lawyers advised Brenton that I would"go away" if documents were denied. I waited for the old sod to retire then got the personal file out. I will place the letter from their lawyers up at some point in the future.

Hit Me Baby, One More Time.

A Welsh GP

Over the last few years, I have stood at the side lines and observed the rubbish the GMC have taken through their hallowed halls. I say this because despite the criticisms in the 2001 report related to Ward 87, no consultant was reprimanded or held accountable. They all continue to practise quite happily. Yet, the consultants, Dr John Green and Dr Monica Spitieri placed patients lives at risk. The General Medical Council was never concerned about the death rate on the ward or was it really concerned about the report verifying the issues I had raised with them in the year 2000. What the GMC was concerned about was making life for me a living hell and leaving the accountability of Ward 87 dead in a ditch. Having messed up, the General Medical Council UK used more than 1 million of doctors' subscription funds defending me in 2004, they currently continue to use more doctors' funds in defending a judicial review later this year. Did the GMC ever ask any of the doctors whether they wanted their money used in this way? Do doctors in the UK want their hard earned finances being spent defending the misdemeanors of the GMC?

The GMC's obsession with sexual innuendo has been self evident for many years. That is because they don't understand important things like patient safety or good patient care. That is why the GMC has the maximum number of whistleblowers within their system [ not me at present]. Their smutty mind has always been evident during the internal discussions of committee members. It is the sheer titillation of sex that the GMC feel compelled to whip. I have this theory, if the GMC Committee members spent more time having good sex and less time being lazy, they might be in a better state to think logically and rationally. I am merely following the advice dished out on NHS Direct.

It was no surprise when I was sent the tale of the Whip and Thong GP.

"A DOCTOR who broke down on a reality TV show has been rapped for insulting his patients and being rude to colleagues.

Dr George Skea worked as a GP for 10 years, with a stint at health centres in Rhymney, Caerphilly, and Abertillery, Blaenau Gwent, before becoming a psychiatric doctor. He even starred in an ITV1 fly-on-the-wall documentary called At The Doctors.

But the work load got too much for him – and the cameras filmed him storming out of his job after he reached the end of his tether in 2003.

Last week the Scot was pulled in front of the General Medical Council for a SECOND time after persistent inappropriate and unprofessional behaviour.

In April 2007 Dr Skea was ordered to be regularly reviewed by a senior after he suggested to a new GP that a female colleague would look good dressed in black leather knee-high boots, a whip and thong.

The GMC panel said: “During a telephone conversation with a paediatric SHO on November 11, 2004 you said ‘Hi, it’s George Skea here, one of the GPs on call, um, can I beg your indulgence please please and if you want to stick your big toe down I’ll suck it as well’.

“On Saturday, February 5 2005, the service manager for Gwent General Practice Out of Hours Service was introducing a new male GP to female staff at the Mamhilad Call Centre when you said words to the effect of ‘wait till you see her in her black leather knee-high boots and her whip and thong’.

You have admitted that your conduct on both occasions was inappropriate and unprofessional. The Panel is of the view that all colleagues and patients are entitled to expect a reasonable standard of courtesy and manners from you and it concurred with the assessors in the judgement that your relationship with colleagues and patients was unacceptable.”

So essentially, no one has a sense of humour!

And which patients were harmed during these comments? None, of course.

Of late we have been discussing the case of Dr Sean Connery of the Scotland Highlands Deanery who was apparently rude to Carol Black and then suspended following hag power. The story is fluctuating up and down faster than a bride's nightie, at first he was reinstated back to work then he wasn't, then no one was certain. I have no idea why Dr Sean Connery just doesn't email one of us. I checked the GMC register and he seems to be just fine so I wasn't worried. Maybe, Dr Connery is happily engaging in observational skills of thigh length boots and whips in his personal life. I certainly hope so because the boy needs a break.

It is though interesting to see that the GMC expects high standards of courtesy from doctors but does not feel it should adhere to this standard themselves. Having seen the memos in my case, I can fully conclude that the GMC are dirtbags and nothing more. The GMC admitted to a discreet and covert enquiry in my case. In normal terms, that means illegal activities. I wouldn't be surprised if GMC towers with their new powers were found hiding under the double bed of every doctor observing what they get up to behind closed doors.

"To avoid bias on grounds of sex, race, disability, lifestyle, culture, beliefs, colour, gender, sexuality or age."
During that time, she has part of the council allowed this to happen. Also during this time, she has sat around at committee meetings clearly eating cakes and accepting the violation of human rights that has taken place. As a GMC committee member she is also a Trustee. As a Trustee she is responsible for ensuring that doctors subscription fees are spent wisely.

Here she is caring about frontline staff.

I do though like this Wikipaedia entry outling the history of her antics with the used tea bags of the medical profession.

While stuffing up the MMC doctors, she said

"These aspirations encompass the creation of the right conditions in which doctors can deliver high quality medicine to the benefit of their patients and have a satisfying career with the infrastructural and educational facilities to support all this. The tasks ahead will not be easy. Challenges for the College include the future of postgraduate medical education and the need to form better relationships with the patients and the public"

The Society of Occupational Medicine publishes this. Perhaps Elizabeth Miller could confirm whether she was ever asked to contribute to this report? When DSL was in danger of closing, did Dame Carol Black offer her support? My question is this, she seems to care so much for the working population, does she care for sick doctors?

This Rate Your MD assessment is amusing. This is a talk given by Carol Black where she talks about "accountability" :)

More from Dame Carol

"“Giving up clinical practice to devote more time to medical management and national politics has been my greatest personal challenge. At times I was doubtful about my abilities. Was I strong enough for such a leadership role? I knew that leadership was not about being popular and you are not always able to do what everyone wants. With hindsight I wish I had been braver. I also wish someone could have talked me through it, even talked me through my mistakes. In the future I would like to see more women filling the top posts in medicine. Women are certainly capable enough to take on these major roles, but they need energy, desire, and support to achieve this"

All the BMJ articles on Carol Black is here.

So come on Dame Carol - deal with the issues related to Ward 87, GMC and me. Let us see what your leadership skills are made of. Lets see if Dame Carol can stand by her big words in the talk she gave about " professionalism and accountability". Carol likes to quote Ian Kennedy barrister at the Bristol Inquiry, Ian likes to quote Carol in this Learning From Bristol document. What is true of both of them is that they do not consider or pay attention the reality of whistleblowing. Actually, neither do either of them care. Dame Carol of course won't assist because I am a whistleblower and she is Dame Carol. That's why it gets dealt with by the judges. The judges deal with it, the working doctors pay the GMC's legal fees for defending the GMC's position [against me] and Dame Carol [like each committee member] sits on her butt eating cake. That is justice at the GMC for you.
